Hi there, we're Kitcast Inc. and welcome to our privacy policy. This policy sets out how we handle your personal information if you're a Kitcast user or visitor to our Sites.
The following terms and conditions govern all use of (i) the Kitcast Inc. dashboard and product pages (the "Sites"), and (ii) the services and products available at or through the Kitcast application (the "Service" or "Application"). Kitcast Inc. provides the Application for Apple TV, Android TV, Amazon Fire TV, Samsung Tizen, LG webOS, BrightSign, ChromeOS, macOS, and iOS to stream and display content uploaded and/or created via the Kitcast dashboard.
When we say "we," "us," or "Kitcast" it's because that's who we are and we own and run the Sites. If we say "policy" we're talking about this privacy policy.
The Service is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies, and procedures that may be published from time to time on this Site by Kitcast Inc.
Please read this privacy policy carefully before accessing the Site or otherwise using the Service. By accessing the Site or using any part of the Service, you (either an individual or a legal entity that you represent as an authorized employee or agent) ("you") agree that you are bound by the terms and conditions of this privacy policy. If you do not agree to all the terms and conditions of this privacy policy, then you may not access the Site, the Service, or any part thereof.
The Service is available only to individuals who are at least 16 years of age, or the applicable minimum age of digital consent in their jurisdiction. If you do not so qualify, do not attempt to use the Service. Kitcast Inc. may refuse to offer the Service to any person or entity at any time and may change its eligibility criteria at any time, in its sole discretion.
DEFINITIONS
- "Service" or "Application" means the software application for Apple TV, Android TV, Amazon Fire TV, Samsung Tizen, LG webOS, BrightSign, ChromeOS, macOS, and iOS platforms that provides a technical solution for displaying and managing digital signage content, moderated by a User.
- "Site" or "Dashboard" or "Product page" means the web-based part of the Kitcast functionality that provides a User with information regarding Kitcast services and/or the tools for adding and managing the content to display via the Service.
- "Add-ons" or "Extensions" means a certain combination of qualitative and quantitative characteristics of the Site and the Service a User may choose to subscribe to for the corresponding fee.
- "License" means your right to use all or part of the features provided by the Site and the Service in accordance with your current subscription plan, add-ons, or obtained in-app purchases.
- "Use" or "using" means to access, install, download, copy, or otherwise benefit from using the functionality of the Site and the Service.
- "Data Controller": Kitcast Inc. (hereinafter referred to as "Owner").
- "Personal Data" or "Personal Information" means any information relating to an identified or identifiable natural person, including but not limited to names, email addresses, IP addresses, device identifiers, and usage data. For California residents, this includes all categories of personal information as defined under the CCPA/CPRA.
- "Sensitive Personal Information" means Personal Data that reveals racial or ethnic origin, religious beliefs, mental or physical health information, sexual orientation, citizenship or immigration status, genetic or biometric data, precise geolocation, or the personal information of a known child under 16, as well as financial account credentials when combined with required access codes.
- "Sale" or "Selling" includes disclosing, disseminating, making available, transferring, or otherwise communicating personal information for monetary or other valuable consideration, as defined under the CCPA/CPRA.
- "Sharing" means communicating personal information for cross-context behavioral advertising, as defined under the CCPA/CPRA.

Jurisdiction and applicable regulations: This Privacy Policy has been prepared in accordance with, and taking into account, applicable data protection and privacy laws, including Articles 13 and 14 of Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR), the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), the Delaware Personal Data Privacy Act, and other applicable U.S. state privacy laws.
LEGAL BASIS OF PROCESSING
The Owner may process Personal Data relating to Users if one of the following applies: Users have given their consent for one or more specific purposes; provision of Data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof; processing is necessary for compliance with a legal obligation to which the Owner is subject; processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Owner; processing is necessary for the purposes of the legitimate interests pursued by the Owner or by a third party.
Under the CCPA/CPRA, we process personal information based on the following business purposes: performing services (account management, customer service, processing transactions), security and fraud prevention, debugging, short-term transient use, and undertaking activities to improve and develop our Services.

MODIFICATION
Kitcast Inc. reserves the right, at its sole discretion, to modify this Privacy Policy at any time. If we modify this Privacy Policy, we will post the modification on the Site or provide you with notice of the modification via email. Material changes will be communicated at least 30 days before they take effect. By continuing to access or use the Service after we have posted a modification on the Site or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Privacy Policy. If the modified Privacy Policy is not acceptable to you, your only recourse is to cease using the Service.
COLLECTION OF PERSONAL INFORMATION
The type of personal information we collect:
We collect certain personal information about visitors and users of our Sites. The most common types of information we collect include: user-names, email addresses, IP addresses, other contact details, survey responses, payment information such as payment agent details, transactional details, tax information, support queries, content you direct us to, device information (device type, operating system, unique device identifiers), browser type and version, and web analytics data.

Although we generally collect personal information directly from you, on occasion, we also collect certain categories of personal information about you from other sources. In particular:
- Financial and/or transaction details from payment providers in order to process a transaction
- Third-party service providers (such as Google) which may provide information about you when you link, connect, or login to your account with the third-party provider and they send us information such as your registration and profile from that service. This only occurs if you are using Kitcast. The information varies and is controlled by that service provider or as authorized by you via your privacy settings at that service provider
HOW WE USE PERSONAL INFORMATION
We will use your personal information for the following purposes:
- To fulfill a subscription (and/or the add-on purchase), or take steps linked to a subscription, in particular facilitating and processing transactions that take place on the Sites
- Where this is necessary for purposes which are in our, or third parties', legitimate interests, including:
- Operating the Sites and providing the Service
- Verifying your identity when you sign in
- Responding to support tickets and helping resolve disputes
- Sending operational news and information about our Sites and services
- Carrying out technical analysis to improve the Sites and services
- Monitoring activity on the Sites to identify potentially fraudulent activity

If our practices change in the future, we will update this Privacy Policy and provide a "Do Not Sell or Share My Personal Information" link on our website.
WHEN WE DISCLOSE YOUR PERSONAL INFORMATION
We will disclose personal information to the following recipients:
- Partners and resellers of the Kitcast services
- Subcontractors and service providers who assist us in connection with the ways we use personal information, including: website hosting providers, technical and customer support services, marketing and analytics services, security and fraud prevention services, subscription management services, payment processing services, and operational tooling services
- Our professional advisers (lawyers, accountants, financial advisers, etc.)
- Regulators and government authorities in connection with our compliance procedures and obligations
- A purchaser or prospective purchaser of all or part of our assets or our business, and their professional advisers, in connection with the purchase
- A third party to respond to requests relating to a criminal investigation or alleged or suspected illegal activity
- A third party, in order to enforce or defend our rights, or to address financial or reputational risks
- A rights holder in relation to an allegation of intellectual property infringement or any other infringement
- Other recipients where we are authorized or required by law to do so
Our subcontractors and service providers may transfer and access such information from other countries in which they have operations. We take appropriate measures to ensure that such transfers comply with applicable data protection laws.
DATA RETENTION
We retain your personal information for as long as is necessary to provide the services to you and others, and to comply with our legal obligations. The specific retention periods vary depending on the type of data and the purpose for which it was collected:
- Account information: retained for the duration of your active account plus 12 months after account closure
- Transaction records: retained for 7 years as required by applicable tax and accounting laws
- Usage and analytics data: retained for up to 26 months
- Support tickets and communications: retained for up to 3 years after resolution
- Marketing preferences: retained until you opt out or request deletion
If you no longer want us to use your personal information or to provide you with the Kitcast services, you can request that we erase your personal information and close your Kitcast account. Please note that if you request the erasure of your personal information, we will retain information from deleted accounts as necessary for our legitimate business interests, to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the terms of service and take other actions permitted by law. Our Website may contain links to other websites and uses functions, cookies, and utilities provided by third parties that are not under our direct control. These websites may have their own policies regarding privacy. We have no control of or responsibility for linked websites and provide these links solely for the convenience and information of our visitors. You access such linked websites at your own risk. These websites are not subject to this Privacy Policy. You should check the privacy policies of those individual websites to see how their operators will utilize your personal information.
ANALYTICS
We use Google Analytics, a web analysis service provided by Google LLC ("Google"). Google Analytics uses cookies and similar technologies to collect and analyze information about the use of the Service. Google utilizes the data collected to track and examine the use of this Website, to prepare reports on its activities and share them with other Google services. Google may use the data collected to contextualize and personalize the ads of its own advertising network. WHERE WE TRANSFER AND/OR STORE YOUR PERSONAL INFORMATION
We are based in the US so your data will be processed in the US. Some of the recipients we have described above are based outside the US in places like Canada, Ireland, Philippines, Poland, Romania, UK, and others.
For transfers of personal data from the European Economic Area (EEA), UK, or Switzerland to the US or other countries, we rely on appropriate transfer mechanisms including Standard Contractual Clauses (SCCs) adopted by the European Commission, the EU-U.S. Data Privacy Framework (where applicable), and/or your consent to this policy. HOW WE KEEP YOUR PERSONAL INFORMATION SECURE
We store personal information on secure servers (Amazon Web Services (AWS)) that are managed by us and our service providers. Personal information that we store or transmit is protected by security and access controls, including username and password authentication, two-factor authentication, data encryption in transit (TLS/SSL) and at rest where appropriate, SSO integration, and audit logging. We conduct regular security assessments and maintain reasonable security practices to protect your personal information.
YOUR RIGHTS UNDER THE GDPR
Users located in the European Economic Area, UK, or Switzerland are entitled to the following rights regarding their Personal Data processed by the Owner:
- Withdraw their consent at any time where they have previously given their consent to the processing of their Personal Data
- Object to processing of their Data if the processing is carried out on a legal basis other than consent
- Access their Data and obtain disclosure regarding certain aspects of the processing and obtain a copy of the Data undergoing processing
- Verify and seek rectification of the accuracy of their Data and ask for it to be updated or corrected

- Right to Opt-Out of Sale/Sharing: You have the right to opt out of the sale of your personal information or the sharing of your personal information for cross-context behavioral advertising. As stated above, we do not currently sell or share your personal information
- Right to Limit Use of Sensitive Personal Information: You have the right to limit the use and disclosure of your sensitive personal information to only those purposes necessary to perform the services
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights

We may extend this period by an additional 45 days when reasonably necessary, with notice to you. You may also designate an authorized agent to submit requests on your behalf.
RIGHTS UNDER OTHER U.S. STATE PRIVACY LAWS
Residents of states with comprehensive privacy laws (including but not limited to Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Delaware, Iowa, New Hampshire, New Jersey, Nebraska, Minnesota, Maryland, Tennessee, Indiana, Kentucky, and Rhode Island) may have similar rights to access, correct, delete, and port their personal data, as well as the right to opt out of targeted advertising, profiling, and the sale of personal data. HOW TO EXERCISE THESE RIGHTS
Any requests to exercise your privacy rights can be directed to the Owner through the contact details provided in this document. These requests can be exercised free of charge and will be addressed by the Owner as early as possible and always within the timeframes required by applicable law (generally within one month for GDPR requests, and 45 days for CCPA/CPRA requests).
AUTOMATED DECISION-MAKING
Kitcast Inc. does not use automated decision-making technology (ADMT) to make significant decisions about you that produce legal effects or similarly significant effects. If we begin using such technology in the future, we will update this Privacy Policy and provide appropriate notice and opt-out mechanisms as required by applicable law.
COOKIES AND WEB ANALYTICS
When you visit our Sites, there is certain information that is recorded which is generally anonymous information and does not reveal your identity. If you are logged into your account, some of this information could be associated with your account. This includes:
